Constitution



I must apologize for my extended absence. I was busy bounty hunting with Dale Gribble. Things were fine until he caught rabies.

Anywho, I must first address Comrade Konstankotaiazichi;e'as post about Wing Wong Ding Dong vs. United States, 1896.
The Chinese Exclusion Act imposed imprisonment at hard labor and deportation to Chinese persons convicted of unlawful entry to or presence in the United States. Wong Wing was charged under the Act. A commissioner of the Circuit Court (who was not a judge) found that Wong Wing was an unlawful alien and sentenced him to 60 days at hard labor followed by deportation to China. Wong Wing sought a writ of habeas corpus, but it was denied. He appealed to the Supreme Court.
I do not see how this case relates to enemy combatants captured in "overseas contingency operations". I patiently await your response Komraid. Obviously my absence has caused my spelling skills to diminish greatly.

I find one very important quote in this:
I ask this question: Who will limit the expansion of government? President Obama and the Executive Branch? Speaker Pelosi or Senate Majority Leader Reid? The Supreme Court? For the moment, The Supreme Court is the only chance we have. Once Sonia Sotomayor, an activist judge is confirmed, Ruth Bader Ginsberg will resign and then we have not one branch of government to stop the wild ride to Socialism. By the way, Socialism whether Americans want it or not, and I believe a huge majority do not want it, is unconstitutional. The preamble to the Constitution makes it clear:

We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.
I never defended every action of George W. Bush. I found his economic policies after his second election, to be poorly managed. Don't look at Obama as a Democrat, or a Republican. I do not look at politicians through such eyes. There are good and bad of both parties. But I must now challenge you my friends....to see if you can truly look and see that Obama is circumventing the Constitution?
